Wayne Hughes Trucking Inc. seeks damages after I-77 accident in North Carolina

BECKLEY – A Shady Spring trucking company alleges one of its vehicles was damaged in a collision in North Carolina.

Wayne Hughes Trucking Inc. filed a complaint July 13 in Raleigh Circuit Court against Salem Corp., Salem Leasing Corp., Salem Carriers Inc. and Don D. Eubanks alleging negligence.

According to the complaint, the plaintiff alleges that on July 13, 2015, its employee was traveling on Interstate 77 in North Carolina when Eubanks, who was an employee of Salem defendants, collided with the plaintiff's truck. The plaintiff alleges its vehicle was significantly damaged.

The plaintiff alleges it has tried to resolve the matter with the defendants without litigation but the defendants' liability insurer has failed to acknowledge the fault of its insured.

The plaintiff requests a trial by jury and seeks compensatory damages, interest, punitive damages, all legal fees and any other relief as the court deems just. It is represented by Jared C. Underwood of Pullin, Fowler, Flanagan, Brown & Poe in Beckley. The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
