Woman alleges she fell in Kmart because of greasy floor

CHARLESTON – A Nitro woman alleges she was injured while shopping at Kmart because of the condition of the floor.

Tonya Summerfield filed a complaint July 26 in Kanawha Circuit Court against Kmart Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 3, 2016, she was at defendant's Charleston store and was seriously injured when she slipped and fell on a greasy substance on the women's restroom floor. 

The plaintiff holds Kmart Corp. responsible because the defendant allegedly failed to examine the premises for unsafe and dangerous conditions and failed to warn business invitees of the existence of such condition.

The plaintiff requests a trial by jury and seeks compensatory damages, plus interest and costs of the action. She is represented by Clayton G. Anderson of The Masters Law Firm LC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
