Individual files suit against Webster Nursing and Rehabilitation Center after mother suffered five falls

WEBSTER SPRINGS – A Webster County woman alleges that her mother received negligent care at a Cowen nursing home.

Phyllis K. Hoke, as power of attorney for Dorotha M. Hall, filed a complaint July 31 in Webster Circuit Court against Webster Nursing and Rehabilitation Center LLC, Wisteria LLC and AMFM LLC alleging negligence

According to the complaint, the plaintiff alleges that Hall was a resident of Webster Nursing and Rehabilitation Center from September 2015 to July 2016. The suit states Hall suffered five falls while in the defendants' care and the defendants also failed to provide care to prevent recurrent urinary tract infections.

The plaintiff holds Webster Nursing and Rehabilitation Center LLC. Wisteria LLC and AMFM LLC responsible because the defendants allegedly failed to properly staff the facility, provide proper supervision and failed to maintain a safe premises.

The plaintiff seeks all damages, litigation costs and any other relief as the court sees fit to award. She is represented by Jeff D. Stewart, Andrew L. Paternostro and Shayla M. Rigsby of The Bell Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Jack Alsop.
