CHARLESTON – A Parkersburg corporation is alleged to have failed to remit payment from a Medicare settlement to a Tennessee health care system.
Columbia Parkersburg Healthcare System LLC filed a complaint Aug. 7 in U.S. District Court for the Southern District of West Virginia against Camden-Clark Memorial Hospital Corp. alleging conversion and unjust enrichment.
According to the complaint, the plaintiff is seeking to recover more than $190,000 in Medicare reimbursement money for services provided at St. Joseph's Hospital prior to 2006. The plaintiff alleges that the defendant improperly held this money.
The suit states that the money is from a settlement agreement with the U.S. Department of Health and Human Services to resolve disproportionate share payments.
The plaintiff holds Camden-Clark Memorial Hospital Corporation responsible because the defendant allegedly failed and refused to remit the Medicare disproportionate share payment to the plaintiff.
The plaintiff seeks $195,577 in damages, interest, all legal fees and any other relief as the court deems just. It is represented by David K. Hendrickson and John K. Cecil of Hendrickson & Long PLLC in Charleston.
