Phillips Machine Service alleged to have failed to pay for goods delivered

BECKLEY – A Beckley business is alleged to have failed to pay for goods provided by a Pennsylvania company.

Enersys, formerly known as Yuasa Inc., filed a complaint Aug. 7 in Raleigh Circuit Court against Phillips Machine Service Inc. alleging breach of contract.

According to the complaint, the plaintiff sold goods to the defendant, who accepted and did not reject them. 

The plaintiff holds Phillips Machine Service Inc. responsible because the defendant allegedly failed to pay the invoices the plaintiff sent.

The plaintiff seeks $67,779.29 plus interest at the rate of 7 percent, all legal fees and any other relief as the court deems just. It is represented by John R. Keating of Amato Keating and Lessa, P.C. in Bethlehem, Pennsylvania. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
