Parties in Weirton crash claim driver's brakes were not properly serviced

NEW CUMBERLAND – Two Weirton individuals allege they were injured when another driver's brakes failed, causing a collision.

Dawn Baker and Rodney McIntyre filed a complaint Aug. 10 in Hancock Circuit Court against Ewusiak Enterprises Inc., Amerilube Inc., Nicholas Loprete and Allstate Property and Casualty Insurance Co. alleging negligence.

According to the complaint, the plaintiffs allege that on Sept 9, 2015, they were traveling on Potomac Avenue in Weirton and sustained serious injuries and damages when their vehicle was struck from the rear by the vehicle being operated by defendant Loprete. The suit states Loprete had his brakes serviced by Ewusiak Enterprises Inc. and Amerilube Inc. and was unable to stop his vehicle.

The plaintiffs request a trial by jury and seek compensatory and general damages, pre- and post-judgment interest, attorney's fees, costs and such other just and proper relief. They are represented by Dean G. Makricostas of Dittmar, Taylor & Makricostas PLLC in Weirton. The case has been assigned to Circuit Judge James P. Mazzone.
