Bluefield Limited Partnership alleges Kmart is behind on rent

PRINCETON – Kmart Corp. is alleged to have failed to pay rent on a Bluefield property.

Bluefield Limited Partnership filed a complaint Aug. 10 in Mercer Circuit Court against Kmart Corp. alleging unlawful detainer.

According to the complaint, the defendant leased a Bluefield property from the defendant and signed the lease agreement in 1991. The suit states the defendant vacated the premises in 2016 but continued to pay rent through June 2017.

The plaintiff holds Kmart Corp. responsible because the defendant allegedly refused to pay rent, wrongfully withheld possession of the premises and failed to quit the premises.

The plaintiff seeks judgment against defendant for possession of the property, award for all damages and such other just and equitable relief. It is represented by D. Kyle Deak of Troutman Sanders LLP in Raleigh, North Carolina and Michael C. Litman of Troutman Sanders LLP in Richmond, Virginia. The case has been assigned to Circuit Judge William J. Sadler.
