BECKLEY – A Beckley man working as a pizza delivery driver is seeking damages after he was shot during a robbery attempt while making a delivery.
Freeman Eugene King III filed a complaint Aug. 10 in Raleigh Circuit Court against Willbrian Apartments LTD, Housing Management Inc., Ryan Adam Amick, Brandon Keith Pack and Kadijah Butler alleging negligence and assault and battery.
According to the complaint, the plaintiff alleges that on Aug. 15, 2015, he was delivering pizza at Willbrian Apartments in Beckley when he was shot in the leg during a robbery attempt by defendants Amick, Pack and Butler. He alleges he has suffered severe injuries, emotional trauma, lost wages, inconvenience and other damages.
The plaintiff holds Willbrian Apartments LTD, Housing Management Inc., Amick, Pack and Butler responsible because defendants Willbrian and Housing Management allegedly failed to properly manage, monitor and secure the apartment facilities and defendants Amick, Pack and Butler conspired and committed torts of assault and battery by intentionally shooting him in the leg.
The plaintiff seeks compensatory damages, attorney's fees, costs and such other relief as the plaintiff may deem just. He is represented by Anthony J. Sparacino of Anthony J. Sparacino Law Office in Beckley. The case has been assigned to Circuit Judge Andrew Dimlich.
