Nurse accuses Raleigh General Hospital of age discrimination

BECKLEY – A Mount Hope woman alleges that she was wrongfully terminated from her position as a nurse with a health care facility because of her age.

Susan Daniel filed a complaint Aug. 14 in Raleigh Circuit Court against Raleigh General Hospital LLC alleging violation of the West Virginia Human Rights Act.

According to the complaint, the plaintiff alleges that she was hired by the defendant as a nurse in 1997 and was 51 at the time of her termination. The suit states in 2014, she was written up for attempt to enforce the policy against junior volunteers providing patient care and was suspended for three days without pay. She alleges she returned to a hostile work environment and took a medical leave in September 2014 because of stress. The suit states she was terminated on Aug. 28, 2015.

The plaintiff holds Raleigh General Hospital LLC responsible because the defendant allegedly terminated her because she reported wrongdoing, because of her age and the fact that she was disabled or perceived as disabled by the defendant.

The plaintiff requests a trial by jury and seeks monetary damages, compensatory damages, punitive damages, all legal fees, reinstatement, all other damages and any other relief as the court deems just. She is represented by Stephen P. New and Amanda J. Taylor of The Law Office of Stephen P. New in Beckley. The case has been assigned to Circuit Judge Andrew Dimlich.
