Cole Truck Parts alleges former employees unlawfully took more than $1 million

PRINCETON – A Bluefield business alleges that two former employees converted more than $1 million for their personal use and for a bakery.

Cole Truck Parts Inc. filed a complaint Aug. 11 in Mercer Circuit Court against Roseanna Coomes; Jessica Johnson, doing business as Cupcake Kisses; and Robert Brad Johnson, doing business as Cupcake Kisses alleging conversion, unjust enrichment and civil conspiracy.

According to the complaint, Coomes and Jessica Johnson are mother and daughter and former employees of the plaintiff. The plaintiff alleges that it discovered in August that from January 2007 to August, Coomes and Jessica Johnson engaged in a scheme to wrongfully convert money from the plaintiff to Cupcake Kisses and to themselves. The plaintiff alleges Coomes deposited $682,977 of its money to her personal bank account and deposited $341,214 to Jessica Johnson's back account with her husband, Robert Brad Johnson.

The plaintiff seeks compensatory damages, interest, punitive damages, all legal fees, and return all assets back to the ownership of Cole Truck Parts. They are represented by Brian K. Cochran of Brewster, Morhous, Cameron, Caruth, Moore, Kersey & Stafford PLLC in Bluefield. The case has been assigned to Circuit Judge Derek C. Swope.
