A.D. Transport Express seeks damages from Hutch's Wrecker Service over collision recovery

FAYETTEVILLE – A Handley towing company is alleged to have caused the loss of cargo and a tractor-trailer because of its delay in recovering the equipment.

A.D. Transport Express Inc. filed a complaint Aug. 17 in Fayette Circuit Court against Hutch's Wrecker Service LLC alleging negligence.

According to the complaint, on Sept. 9, 2015, one of the plaintiff's drivers lost control and wrecked on Interstate 79 in Fayette County. The suit states that the driver was hauling goods with a value of $314,939.52 at the time. 

The plaintiff alleges that its president contacted the defendant about the recovery of the tractor-trailer and cargo on Sept. 10, 2015, but the defendant did not complete the recovery until Sept. 14, 2015. The suit states the tractor-trailer and cargo were declared a loss and that the cargo was left unprotected from the elements.

The plaintiff requests a trial by jury and seeks judgment against the defendant for the total loss of its trailer, payment for deductibles caused by the damages, profits, court costs, punitive damages and any further relief the court grants. It is represented by Christopher D. Negley and Caleb B. David of Shuman, McCuskey & Slicer PLLC in Charleston. The case has been assigned to Circuit Judge John W. Hatcher Jr.
