Passenger seeks damages over alleged injuries sustained in collision with Norfolk Southern truck

WILLIAMSON – A Mingo County man alleges he was injured in a collision with a Norfolk Southern Railway vehicle.

Anthony Scales filed a complaint Aug. 16 in Mingo Circuit Court against Rodney Jerome Joplin and Norfolk Southern Railway Co. alleging negligence.

According to the complaint, the plaintiff was a passenger in a vehicle driven by Joplin on Sept. 30, 2016, on county Route 49 when the vehicle collided with a truck owned by Norfolk Southern.

The plaintiff holds Joplin and Norfolk Southern Railway Co. responsible because the defendants allegedly failed to maintain a safe and reasonable speed and failed to keep a proper lookout.

The plaintiff requests a trial by jury and seeks compensatory damages that exceeds the minimum amount of the court, court costs, interest and any further relief the court grants. He is represented by Greg K. Smith of Law office of Greg K. Smith in Williamson. The case has been assigned to Circuit Judge Miki Thompson.
