Man says Garlow Insurance failed to procure policy for rental property

CHARLESTON – A Kanawha County man alleges that an insurance agency failed to procure a property insurance policy for his rental property.

Eric Lang, doing business as Zack and Zion Properties, filed a complaint Aug. 2 in Kanawha Circuit Court against Garlow Insurance Agency Inc. alleging negligence.

According to the complaint, the plaintiff alleges that in May, his rental property on Vine Street in Charleston was destroyed by fire. The suit states the plaintiff believed that his property was insured through a policy obtained by the defendant.

The plaintiff holds Garlow Insurance Agency Inc. responsible because the defendant allegedly failed to procure property and casualty insurance for the Vine Street property and failed to advise him that said property was uninsured.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount necessary to compensate his injuries and damages. He is represented by Christopher D. Pence of Hardy Pence PLLC in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
