NCO Financial Systems alleged to have unlawfully contacted consumer instead of counsel

WAYNE – A consumer claims a debt collector is unlawfully contacting her and is causing emotional distress.

Rosalene Rose filed a complaint Aug. 21 in Wayne County Circuit Court against NCO Financial Systems Inc. and John Doe Business Entity citing the West Virginia Consumer Credit and Protection Act.

According to the complaint, the defendants have been contacting the plaintiff in an attempt to collect an alleged debt. She alleges that in July 2013, she informed the defendants during a phone call that she was represented by counsel and for the defendants to contact her attorney instead.

The plaintiff holds NCO Financial Systems Inc. and John Doe Business Entity responsible because the defendants allegedly continued to contact her directly from her despite knowing she had retained counsel.

The plaintiff seeks actual damages, statutory damages, court costs, general damages, punitive damages and any further relief the court grants. She is represented by Matthew P. Stapleton and Scott G. Stapleton of Stapleton Law Offices in Huntington.
