Man says broken shelf at Kroger store caused fall

LOGAN – A Logan County man alleges he was injured at a grocery store because of a broken shelf.

Roosevelt Allen filed a complaint Aug. 18 in Logan Circuit Court against Kroger Limited Partnership I alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 4, 2016, he was a guest at defendant's grocery store when he slipped and fell on a concealed broken shelf. He alleges he has suffered mental anguish, pain and suffering, medical expenses and loss of enjoyment of life. 

The plaintiff holds Kroger Limited Partnership I responsible because the defendant allegedly negligently failed to promptly fix the broken shelf.

The plaintiff requests a trial by jury and seeks compensatory damages, pre- and post-judgment interest and such other available legal relief. He is represented by Steven S. Wolfe and J. Christopher White of Wolfe, White & Associates in Logan. The case has been assigned to Circuit Judge Joshua Butcher.
