LOGAN – A Logan County man alleges that he was terminated by his employer because he filed a workers' compensation claim.
Jeramie Workman filed a complaint Aug. 18 in Logan Circuit Court against Greenbrier Minerals LLC alleging that the coal mining company violated the West Virginia Human Rights Act.
According to the complaint, the plaintiff was employed by the defendant as an electrician at its Toney Fork coal mine and was injured while working in March 2016. The suit states he filed a workers' compensation claim and was cleared to return to work by his physician in May. He alleges the defendant refused his requests to return to work and terminated him on June 5.
The plaintiff holds Greenbrier Minerals LLC responsible because the defendant allegedly retaliated against him by terminating his employment for filing workers' compensation claim.
The plaintiff requests a trial by jury and seeks reinstatement, award for compensatory and punitive damages, pre- and post-judgment interest and such other just and equitable relief. He is represented by Steven S. Wolfe of Wolfe, White & Associates in Logan.
