Woman seeks declaration regarding insurance coverage after Route 60 collision

HUNTINGTON – An individual is seeking coverage after a motor vehicle accident in Barboursville.

Lynnlee L. Wyatt filed a complaint Aug. 21 in Cabell Circuit Court against Randy Clay Cain, Ronald C. Cain, Stella L. Wyatt, Progressive Max Insurance Co., State Farm Mutual Automobile Insurance Co. and John Does Insurers/insurance companies/insurance carriers 1-20 seeking declaratory judgment.

According to the complaint, the plaintiff alleges that on Dec. 6, 2016, she suffered physical injuries from being involved in a vehicular accident on U.S. Route 60 near Barboursville when Cain went left of center and struck her vehicle. 

The plaintiff is seeking declaratory judgment that Progressive is obligated to provide motor vehicle liability coverage to Cain, which should be made available to the plaintiff to compensate her for damages. She also claims State Farm also should provide coverage for the same reason.

The plaintiff seeks declaratory judgment against the defendant, all legal fees and any other relief as the court deems just. She is represented by Claude S. Smith III in Charleston. The case has been assigned to Circuit Judge Alfred E. Ferguson.
