Consumer claims Synchrony Bank's actions regarding stolen credit card damaged credit

PRINCETON – A Mercer County consumer alleges that his credit was damaged after a credit card was stolen.

Joseph M. Sanders III filed a complaint in Mercer Circuit Court against Synchrony Bank citing state codes.

According to the complaint, the plaintiff had credit card accounts for a Lowe's Home Improvement Centers and for a Bank of America/Master Card. The suit states the defendant mailed him a statement for the Lowe's card account in February 2016 that listed charges and he advised the bank that the card had been stolen. The plaintiff alleges he received a letter from the defendant in November 2016 that stated that the investigation of the disputed amount was complete and the major credit reporting agencies had been notified. However, the plaintiff alleges that Bank of America has refused to reinstate his Master Card account.

The plaintiff holds Synchrony Bank responsible because the defendant allegedly damaged the plaintiff's credit rating by communicating to TransUnion that the account was delinquent after the plaintiff had disputed it.

The plaintiff seeks actual damages, all legal fees, interest and any other relief as the court deems just. He is represented by J. Peter Richardson and C. William Davis of Richardson & Davis, PLLC in Bluefield. The case has been assigned to Circuit Judge William J. Sadler.
