Claxton Smith & Sons Concrete Co. alleges it is owed more than $16,000 for materials

WINFIELD – A construction company is alleged to have failed to pay for goods.

Claxton Smith & Sons Concrete Co. filed a complaint Aug. 10 in Putnam Circuit Court against Fisher Concrete and Construction Inc. and Steven C. Fisher alleging breach of contract.

According to the complaint, the plaintiff alleges that it provided certain materials and supplies to defendants on credit. To date, the principal amount of at least $16,042.17 allegedly remains due and owing. 

The plaintiff holds Fisher Concrete and Construction Inc. and Steven C. Fisher responsible because the defendants allegedly failed and refused to pay the full amount of materials and supplies provided by plaintiff.

The plaintiff seeks payment for the balance amount of $16,042.17, pre- and post-judgment interest, attorney's fees and such other just and appropriate relief. It is represented by Mary K. Prim in Scott Depot. The case has been assigned to Circuit Judge Joseph Reeder.
