Motorist seeks benefits from Westfield Insurance for crash damages

WINFIELD – A Putnam County woman alleges her insurer owes her underinsured motorist benefits after a collision.

Krista D. Capehart filed a complaint Aug. 14 in Putnam Circuit Court against Westfield Insurance Co. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that on Aug. 14, 2015, she sustained serious and permanent injuries and damages when her vehicle was struck by an underinsured motorist on Slab Fork Road. 

The plaintiff holds Westfield Insurance Co. responsible because the defendant allegedly refused to pay a fair and reasonable value of her underinsured motorist benefits claim.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages pre- and post-judgment interest, attorney's fees and costs. She is represented by James B. Atkins of Atkins & Ogle Law Offices LC in Buffalo.
