Man alleges wet towel on convenience store floor caused fall

KINGWOOD – A Preston County man alleges he was injured at a Kingwood business after slipping on a towel.

Orva J. Powell filed a complaint Aug. 22 in Preston Circuit Court against BFS Foods Inc. alleging that the premises occupier failed to provide a reasonably safe and secure environment.

According to the complaint, the plaintiff alleges that on July 6, 2017, he sustained multiple, serious and permanent injuries when he slipped and fell on a wet towel that was on the floor at defendant's BFS Wash & Shop. He alleges he suffered tremendous pain and suffering, loss of household service, inconvenience and all other economic and non-economic damages because of the fall. 

The plaintiff holds BFS Foods Inc. responsible because the defendant allegedly negligently permitted a dangerous condition to develop in the premises and failed to correct or remove such condition.

The plaintiff requests a trial by jury and seeks judgment against defendant of more than $75,000, costs and interest and such other just and proper relief. He is represented by Robert B. Wagner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
