Motorist seeks damages from American Disposal Services, driver after collision

WHEELING – A Wheeling woman is seeking damages after her vehicle was struck by a garbage truck in the city.

Lisa N. Gadd filed a complaint Aug. 24 in Ohio Circuit Court against James S. Fitzsimmons and American Disposal Services alleging negligence.

According to the complaint, the plaintiff alleges that on Oct. 24, 2015, she sustained personal injuries and damages when the motor vehicle she was driving was sideswiped by an American Disposal garbage truck operated by Fitzsimmons on North Fork Road.

The plaintiff holds Fitzsimmons and American Disposal Services responsible because defendant Fitzsimmons allegedly operated the garbage truck at a speed greater than reasonable.

The plaintiff requests a trial by jury and seeks judgment against defendants for all damages sustained by plaintiff and such other legal and equitable relief. She is represented by Teresa C. Toriseva and Joshua D. Miller of Toriseva Law in Wheeling.
