CHARLESTON – A Sav-A-Lot shopper alleges he fell in the store because of spilled sugar.
Charles Tancredi filed a complaint Aug. 7 in Kanawha Circuit Court against Westernport Foods Inc., doing business as Sav-A-Lot Food Stores, alleging negligence.
According to the complaint, the plaintiff alleges that on July 1, he was shopping at the defendant's Cedar Grove location and sustained physical injuries when he slipped and fell because of spilled sugar on the floor. The plaintiff holds Westernport Foods Inc. responsible because the defendant allegedly failed to remove the spilled sugar on the floor or provide adequate warning to the plaintiff regarding the hazardous condition of the floor.
The plaintiff seeks judgment against the defendant in an amount of more than $75,000 plus interest, court costs and any further relief the court grants. He is represented by Robert B. Warner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
