CHARLESTON – A Charleston auto dealer is alleged to have failed to disclose a vehicle's defects before sale.
Patrick Brennan filed a complaint Sept. 11 in Kanawha Circuit Court against Moses Cadillac Buick GMC Truck Inc. alleging unlawful sales practices and negligent misrepresentation.
According to the complaint, the plaintiff purchased a 2008 Cadillac CTS from the defendant. He alleges in 2014, he learned that the vehicle had been previously treated for rust and flooding, and in 2015, the transmission failed.
The plaintiff holds Moses Cadillac Buick GMC Truck Inc. responsible because the defendant allegedly sold the vehicle without disclosing its defects.
The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages that exceeds the jurisdictional limits of this court, court costs and any further relief the court grants. He is represented by Michael M. Cary of Caray Law Office PLLC in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
