Consumers allege damages after installation of tub liner by Bath Save, Ohio Bath Solutions

CHARLESTON – A Charleston couple alleges their bathroom was damaged after the installation of a tub liner.

David Bailey and Kathy Bailey filed a complaint Aug. 11 in Kanawha Circuit Court against Bath Saver Inc., doing business as Bath Fitter, and Ohio Bath Solutions, alleging negligence.

According to the complaint, the plaintiffs allege that the defendants negligently installed a tub liner in their home in April. They allege that they have sustained severe damage to their bathroom, the shower doors do not work properly and the caulking is mismatched.

The plaintiffs hold Bath Saver Inc. and Ohio Bath Solutions responsible because the defendants also allegedly failed to disclose the price of materials, quality of goods and warranty information.

The plaintiffs request a trial by jury and seek damages in excess of the jurisdictional limits of the court, attorney's fees, costs and such other just and proper relief. They are represented by Michael M. Cary of Cary Law Office PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
