State DOH accused of negligence after driver hits expansion joint

CHARLESTON – A driver alleges his car was declared a total loss after striking a large piece of expansion joint while traveling on Interstate 77.

Shayne M. Cooper filed a complaint Aug. 14 in Kanawha Circuit Court against The West Virginia Department of Transportation Division of Highways alleging negligence.

According to the complaint, the plaintiff alleges that on June 28, 2016, he sustained severe and permanent injuries and property damage when his vehicle struck a large piece of expansion joint that was displaced on Interstate 77 in Charleston. 

The plaintiff holds The West Virginia Department of Transportation Division of Highways responsible because the defendant allegedly failed to ensure that the expansion joint was not defective.

The plaintiff requests a trial by jury and seeks damages in an amount which will fairly and adequately compensate plaintiff's damages, pre- and post-judgment interest, costs and attorney's fees and such other necessary relief.
