CHARLESTON – A Fairmont man contracted as an interpreter for Mildred Mitchell-Bateman Hospital alleges his contract was not honored.
James E. Phillips II filed a complaint Aug. 14 in Kanawha Circuit Court against West Virginia Department of Health and Human Resources, doing business as Mildred Mitchell-Bateman Hospital, alleging breach of contract.
According to the complaint, the plaintiff alleges that on April 6, 2016, he entered into an employment contract with defendant to provide interpretation services. As a result of defendant's alleged breach, he claims he has suffered loss of substantial income and other employment opportunities and for acquiring additional insurance and training.
The plaintiff requests a trial by jury and seeks compensatory damages, lost wages, attorney's fees, costs, interest and such other appropriate relief. He is represented by Richard W. Walters of Shaffer & Shaffer PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
