Bounty Minerals LLC seeks to quiet title on Marshall County property

MOUNDSVILLE – A Texas partnership is seeking the court's help in terminating a lease on a Marshall County property.

Bounty Minerals LLC filed a complaint Aug. 29 in Marshall Circuit Court against CNX Gas Co. LLC, Consol Energy and Leatherwood Inc. seeking quiet title and declaratory judgment.

According to the complaint, the plaintiff has an interest in the mineral and gas rights to roughly 95 acres in Marshall County. The suit states that the lease became invalid due to a lapse in production and that the plaintiff sent a letter in December 2016 to CNX requested a recordable release. The plaintiff alleges the defendants have refused to execute a release of the lease.

The plaintiff alleges that it has suffered damages, including the loss of prospective leases, because of the defendants' actions.

The plaintiff seeks judgment against the defendants quieting any claim to the title of the property and declaring that the lease was terminated, compensatory damages, attorney's fees and costs. It is represented by Michael J. Hammond of Dodaro, Matta & Cambest PC in Canonsburg, Pennsylvania. The case has been assigned to Circuit Judge David W. Hummel Jr.
