Individual claims Antero, Key Oil are trespassing, owe royalties

WEST UNION – An Ohio man alleges that he has not been paid royalties for wells in Doddridge County.

H.T. Rominger filed a complaint on Sept. 7 in the Doddridge Circuit Court against Key Oil LLC and Antero Resources Inc. alleging breach of contract.

According to the complaint, the plaintiff and Key Oil entered into an agreement in January 1996 on a tract of 146 acres in Doddridge County. The suit states Key Oil completed three wells in 1996 and 1997 and Key Oil entered into an agreement with Antero in 2011. The plaintiff alleges Antero has drilled five wells that produce gas and oil from the Marcellus Shale formation under the property. 

The plaintiff alleges that Key assigned rights to Antero that it no longer held and that the defendants are trespassing. He also alleges he has not been paid any royalties by the defendants.

The plaintiff seeks judgment against the defendant, unpaid overriding royalties, $25,000 in spud fees, punitive damages, interest, court costs and any further relief the court grants. He is represented by Kyle Nuttall of Kyle Nuttall in Buckhannon. The case has been assigned to Circuit Judge Timothy Sweeney.
