Lowe's, others facing suit over allegedly defective flooring

BECKLEY – A Greenbrier County man and the owner of commercial retail property in Beckley claim that a hardwood floor they had installed in a property was defective and had to be replaced.

Four Aces Properties LLC and John J. Mize filed a complaint Aug. 30 in Raleigh Circuit Court against Lowe's of West Virginia Inc., doing business as Lowe's of Lewisburg; Hartco Flooring Co.; et al. alleging breach of contract.

According to the complaint, the plaintiffs purchased Bruce hardwood flooring from the Lewisburg Lowe's in December 2014 and installation services for a commercial retail building in Beckley. The suit states installation was completed in May 2015.

The plaintiffs allege that during cleaning and inspection, they discovered the flooring was cracking, splitting and chipping because of a manufacturing defect. They allege the entire floor had to be replaced and that Lowe's failed to repair and replace the flooring, violating the breach of implied warranty.

The plaintiffs seek damages, interest and any other relief as the court deems just. They are represented by John J. Mize of Mize Law Firm PLLC in Beckley. The case has been assigned to Circuit Judge Andrew Dimlich.
