WHEELING – A man alleges that his loan was closed by an unauthorized person and that he was charged excessive fees.
Gary DeTemple filed a complaint Sept. 1 in Ohio Circuit Court against American Advisors Group alleging unauthorized practice of law, unjust enrichment and other counts.
According to the complaint, the plaintiff entered into a reverse loan mortgage with the defendant in September 2015 and was charged $770 to close the loan. He alleges the individual hired to close the loan was a notary public instead of a licensed lawyer, which in violation of state law. The plaintiff alleges that the state maximum charge for notary services is $2 and that the $770 closing fee is excessive.
The plaintiff seeks actual and compensatory damages, all legal fees, interest and any other relief as this court deems just. He is represented by James G. Bordas Jr. and Jason E. Causey of Bordas & Bordas PLLC in Wheeling and Martin P. Sheehan of Sheehan & Nugent PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
