Kroger shopper seeks damages after nearly falling in store, injuring back

CHARLESTON – A shopper at the Kroger location in Marmet alleges that she has injured her back after stepping on produce.

Deborah Hill filed a complaint Aug. 21 in Kanawha Circuit Court against The Kroger Co. and Crystal Gilmore alleging premises liability.

According to the complaint, the plaintiff alleges that on Feb. 6, 2016, she injured her back when she slipped and nearly fell when she stepped on a piece of leafy produce on the floor at defendants' Kroger. 

The plaintiff holds The Kroger Co. and Gilmore responsible because the defendant allegedly failed to provide warning of the defective condition.

The plaintiff requests a trial by jury and seeks compensatory, punitive and exemplary damages with penalties and interest, attorney's fees and costs. She is represented by James M. Barber of Law Office of James M. Barber in Charleston. The case has been assigned to Circuit Judge Jennifer F. Bailey.
