Consumers allege water purchased at Family Dollar store was contaminated

CHARLESTON – A Comfort couple alleges a brand of purified water they purchased was falsely represented as "gourmet" water.

Shirley Tincher and Thomas Tincher filed a complaint Aug. 21 in Kanawha Circuit Court against Family Dollar Store of West Virginia Inc., doing business as Family Gourmet, Family Dollar Services Inc. and Niagara Bottling LLC citing the West Virginia Consumer Protection Act.

According to the complaint, the plaintiffs allege that they purchased Family Gourmet purified water in March from the Family Dollar store in Racine. They allege they discovered foreign objects in the water.

The plaintiffs hold Family Dollar Store of West Virginia Inc., Family Dollar Services Inc. and Niagara Bottling LLC responsible because the defendants allegedly claimed the water was purified when it was contaminated.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount of less than $74,999 plus interest and costs. They are represented by Anthony J. Majestro and J.C. Powell of Powell & Majestro PLLC in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
