Man seeks damages from Kroger after falling shelf allegedly injured head

CHARLESTON – A Kanawha County Kroger shopper alleges that he was injured when a shelf fell on his head.

Bobby Holmes filed a complaint Aug. 21 in Kanawha Circuit Court against Kroger Limited Partnership 1 alleging negligence.

According to the complaint, the plaintiff alleges that on July 8, he was seriously injured when the shelf inside the freezer at defendant's Kroger store fell and landed on his head. He alleges he has suffered great pain, humiliation as well as other economic and non-economic damages. 

The plaintiff holds Kroger Limited Partnership 1 responsible because the defendant allegedly failed to provide a safe and secure environment to its patrons and failed to warn them of the dangerous condition of the shelves inside the freezer.

The plaintiff requests a trial by jury, seeks damages and such other just and proper relief. He is represented by Robert B. Warner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Louis J. Bloom.
