WHEELING – An Ohio couple is seeking damages from a surgeon and two health care facilities after a surgical instrument was allegedly left in the husband's body after a surgery.
James R. Wright and Vicki L. Wright filed a complaint in Ohio Circuit Court against K. Steven Wiley, M.D.; Ohio Valley Colon and Rectal Surgeons PLLC; and Alecto Healthcare Services Ohio Valley LLC, doing business as Ohio Valley Medical Center, citing the West Virginia Medical Professional Liability Act.
According to the complaint, the plaintiffs allege that James R. Wright had a foreign metal object left inside his abdomen from the surgery he had on Oct. 19, 2015, performed by the defendants. The foreign object, which was a surgical instrument, was discovered in April 2016 and removed the following month, the suit states.
The plaintiffs hold K. Steven Wiley, M.D.; Ohio Valley Colon and Rectal Surgeons PLLC; and Alecto Healthcare Services Ohio Valley LLC responsible because the defendants allegedly failed to exercise a degree of care.
The plaintiffs request a trial by jury and seek judgment against the defendants for compensatory damages, punitive and/ or exemplary damages, court costs, interest and any further relief the court grants. They are represented by David A. Jividen of Jividen Law Offices PLLC in Wheeling.
