Washburn Property & Contracting alleges it had to replace deck because instructions weren't provided

CHARLESTON –  A Charleston contractor alleges that it was not provided instructions for the installation of vinyl decking.

Washburn Property & Contracting LLC filed a complaint Aug. 24 in Kanawha Circuit Court against The Palmer-Donavin Manufacturing Co. and Genova Products Inc. alleging breach of express and implied warranty, breach of contract and other counts.

According to the complaint, the plaintiff installed decking manufactured by Genova at a job site prior to September 2014. The plaintiff alleges that within a few weeks, the vinyl decking began to develop gaps and the plaintiff had to replace it. It alleges that the defendants failed to provide proper installation instructions.

The plaintiff requests a trial by jury and seeks compensatory damages and any other relief as the court deems just. It is represented by Larry O. Ford of Meyer, Ford & Glasser PLLC in Charleston. The case has been assigned to Circuit Judge Louis. H. Bloom.
