Cabell Co. parents blame school board after child loses tooth on playground

HUNTINGTON – The parents of an elementary school student have filed a suit against the Cabell County Board of Education after the student lost a tooth on the playground.

Kevin Chattin and Mary Chattin, individually and as the natural parents and next friends of Kalel Chattin, filed a complaint Aug. 25 in Cabell Circuit Court against the school board alleging negligence.

According to the complaint, the plaintiffs allege that on Dec. 7, 2016, Kalel Chattin slipped in the wet mulch area at Ona Elementary School and fell, striking playground equipment and causing the loss of his permanent front tooth. 

The plaintiffs hold the Cabell school board responsible because the defendant allegedly installed unsafe playground equipment.

The plaintiffs request a trial by jury and seek compensatory damages, interest, all legal fees, general relief and any other relief as the court deems just. They are represented by Paul E. Biser of Fredeking & Biser Law Offices in Huntington. The case has been assigned to Circuit Judge Gregory L. Howard.
