CHARLESTON – An Amma couple has filed suit against an insurer over coverage for flooding that damaged their home.
Robert L. Mace and Cynthia D. Mace filed a complaint Sept. 5 in U.S. District Court for the Southern District of West Virginia, Charleston Division against Wright National Flood Insurance Co. alleging breach of contract.
According to the complaint, the plaintiffs' home was destroyed by flash flooding on June 23, 2016. They allege they submitted a claim to the defendant and that the defendant paid $100,000 after a significant delay.
The plaintiffs holds Wright National Flood Insurance Co. responsible because the defendant allegedly have only paid the plaintiffs a partial payment and also allegedly have not paid benefits for the increased cost of compliance under the policy.
The plaintiffs request a trial by jury and seek judgment for the amounts owed to the plaintiffs under the policy and any other relief as the court deems just. They are represented by Michael C. Walker of Cyrus, Adkins & Walker in Huntington.
