HUNTINGTON – A McDonald's patron is seeking damages after a fall in the restaurant allegedly caused her to fracture her knee cap.
Norma June McCoy filed a complaint Sept. 7 in Cabell Circuit Court against Abilene Corp., doing business as McDonald's, alleging that the fast food establishment failed to keep their women's restroom reasonably safe for their customers.
According to the complaint, the plaintiff alleges that on Sept. 21, 2016, she was visiting the defendant's Huntington location and slipped and fell inside the women's restroom because of an oily or greasy substance on the floor. She alleges she struck her right knee and hit her head on the floor. The suit states she was diagnosed with a fractured knee cap, possible concussion and scrapes and bruises.
The plaintiff holds Abilene Corp. responsible because the defendant allegedly failed to put up any wet floor signs or any warning signs in the women's restroom and failed adequately inspect or clean the floors at the end of each shift.
The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, all medical expenses, lost wages, interest, all legal fees and any other relief as the court deems just. She is represented by James D. McQueen Jr. and Lia A. Billings of McQueen Davis PLLC in Huntington. The case has been assigned to Circuit Judge Alfred E. Ferguson.
