G.M. McCrossin files suit against Ronceverte over waste water facility contract

BECKLEY – A Pennsylvania company alleges that the city of Ronceverte forced it to incur more labor costs and other damages on a construction project.

G.M. McCrossin Inc. filed a complaint Sept. 8 in U.S. District Court for the Southern District of West Virginia, Beckley Division against the city of Ronceverte alleging breach of contract.

According to the complaint, the plaintiff was awarded a bid by the defendant to construct and/or modify the city's existing waste water treatment facility with construction to begin in 2015.

The plaintiff holds the city of Ronceverte responsible because the defendant allegedly interfered and delayed the plaintiff's performance of the work, failed to provide a design that addressed known soil conditions, failed to timely have necessary permits to begin work and other issues.

The plaintiff requests a trial by jury and seeks damages in excess of $75,000, pre- and post-judgment interest, costs and such just and equitable relief. It is represented by Mychal S. Schulz and Kurt F. Fernsler of Babst, Calland, Clements and Zomnir PC in Charleston.
