Pritchard Mining Co. alleged to owe nearly $400,000 for fuel

CHARLESTON – A Chesapeake business is alleged to have failed to pay for fuel it purchased.

Petroleum Products LLC filed a complaint in Kanawha Circuit Court against Pritchard Mining Co. Inc. alleging breach of contract and unjust enrichment.

According to the complaint, the plaintiff alleges that between Sept. 11, 2013, and Feb. 26, 2014, it supplied fuel to defendant on a regular basis. To date, the total amount of $395,084.81 allegedly remains due and unpaid.

The plaintiff requests a trial by jury and seeks damages in the amount of $395,084.81, pre- and post-judgment interest, attorney's fees, costs and such other just and proper relief. It is represented by Peter J. Raupp and Joseph U. Leonoro of Steptoe & Johnson PLLC in Charleston. The case was assigned to Circuit Judge Joanna Tabit.
