Couple claims Plateau Insurance wrongfully denied disability benefit claim

HUNTINGTON – A Huntington couple has filed a suit against their insurer after a disability claim was denied.

Harold Estep and Linda Estep filed a complaint Sept. 11 in Cabell Circuit Court against Plateau Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Aug. 1, 2016, Harold Estep became temporarily disabled and made claim for benefits from the defendant under their credit life/disability insurance policy. The suit states the claim was denied.

The plaintiffs holds Plateau Insurance Co. responsible because the defendant allegedly violated the terms of their contractual agreement with the plaintiffs by failing to honor the claims filed by the plaintiffs for benefits.

The plaintiffs request a trial by jury and seek all damages, punitive damages, court costs, and prejudgment and post-judgment interest. They are represented by Kenneth P. Hicks and D. Geoffrey Varney of Kenneth P. Hicks LC in Huntington. The case has been assigned to Circuit Judge Alfred E. Ferguson.
