NEW MARTINSVILLE – A Proctor couple is seeking damages after the husband was injured in a flash fire at a well pad in the Wetzel County.
Randy and Nancy Eller filed a complaint Sept. 12 in Wetzel Circuit Court against Stone Energy Corp. alleging negligence.
According to the complaint, the plaintiffs allege that on Oct. 28, 2016, Randy Eller was employed by a third-party company and was working at Howell Pad, a natural gas well pad owned and operated by the defendant in New Martinsville. The suit states that the defendant was performing maintenance on the pad and that a release of gas caused a flash fire, which injured the plaintiff.
The plaintiffs hold Stone Energy Corp. responsible because the defendant allegedly failed to use due care, failed to train workers in the recognition of hazardous energy sources and failed to perform a proper job hazard assessment.
The plaintiffs request a trial by jury and seek judgment against defendant for compensatory and punitive damages, costs, expenses, fees, interest and other relief deemed proper by the court. They are represented by Geoffrey C. Brown and James G. Bordas of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
