Mine examiner alleges he was wrongfully discharged by Alliance Coal, Tunnel Ridge

WHEELING – A Nicholas County man alleges he was discharged in retaliation after raising whistle-blower complaints and objections.

Brian High filed a complaint Sept. 13 in Ohio Circuit Court against Alliance Coal LLC, Tunnel Ridge LLC and Eric K. Anderson citing unlawful retaliation

According to the complaint, the plaintiff was hired by the defendants as a mine examiner at the Tunnel Ridge Mine in October 2013. He alleges that on Sept. 17, 2015, he was terminated from his employment after refusing to remove entries from safety books citing hazardous conditions.

The plaintiff also alleges that after termination, the defendants failed to pay him a bonus due to him and outstanding vacation pay.

The plaintiff seeks compensatory and punitive damages, pre- and post-judgment interest, attorney's fees, costs and such other just and equitable relief. He is represented by Michael A. Olivio and Stephanie H. Daly of Olivio Law Firm PLLC in Charleston. The case has been assigned to Circuit Judge Ronald E. Wilson.
