Salem International University seeks damages from insurer over coverage claim

MOUNDSVILLE – A for-profit college alleges its insurer has breached the terms of its policy by failing to provide full coverage in connection with lawsuits against the institution.

Salem International University LLC, John Luotto, Dr. Susie Wilson, and Gerard M. Francois filed a complaint Sept. 22 in Marshall Circuit Court against National Union Fire Insurance Co. of Pittsburgh alleging breach of contract and other counts.

According to the complaint, three lawsuits were filed against the plaintiffs in 2013 and 2014 and that the plaintiffs requested coverage and indemnification under the terms of their policy with the defendant for the claims. The suit states that the defendant notified the plaintiffs that it would only pay 35 percent of the liability. 

The plaintiffs hold National Union Fire Insurance Co. of Pittsburgh PA responsible because the defendant allegedly has breached the contract by failing to provide full coverage for the claims.

The plaintiffs seek compensatory damages, punitive damages, interest, court costs and any further relief the court grants. They are represented by Robert P. Fitzsimmons and Mark A. Colantonio of Fitzsimmons Law Firm PLLC in Wheeling. The case has been assigned to Circuit Judge David W. Hummel Jr.
