Mother files suit against Light Enterprises after child was burned

KINGWOOD – A mother residing in Preston County alleges her minor son was injured because their landlord permitted other tenants to unlawfully burn refuse on its lots.

Melissa Bracken, individually and as guardian and next friend of Jacob Bracken, a minor filed a complaint Sept. 19 in Preston Circuit Court against Light Enterprises Inc. alleging negligence.

According to the complaint, the plaintiffs rented a factory built home site in Holly Park, which is owned and operated by the defendant. The suit states that on Aug. 2, 2016, Jacob Bracken was burned and suffered grievous injuries to his body while a Holly Park resident was burning refuse.

The plaintiffs hold Light Enterprises Inc. responsible because the defendant allegedly failed to adopt and provide rules and regulations regarding the burning of refuse on the residential lots at the Holly Park community.

The plaintiffs request a trial by jury and seek damages in an amount that will fairly compensate plaintiffs' damages, pre- and post-judgment interest, attorney's fees and such other just and proper relief. They are represented by Paul C. Estep of Estep & Shaffer LC in Kingwood. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
