Pedestrian blames Huntington for injuries from sidewalk

HUNTINGTON — A Cabell County man is suing Huntington, alleging negligence and premises liability.

Dean Fuller filed a complaint Sept. 27 in Cabell Circuit Court against the city of Huntington and M.J. Zones LLC, alleging that they failed to maintain the sidewalk in a reasonably safe condition.

According to the complaint, on June 12, 2016, Fuller, while walking to the barber shop, was injured when he slipped and fell as a result of the sidewalk being in disrepair from a tree-well in front of D.P. Dough at 1520 Fourth Ave. in Huntington. The suit says Fuller sustained significant injuries resulting in pain and suffering, medical expenses and disability and incurred medical expenses. 

The plaintiff alleges the the defendants negligently allowed a dangerous condition to exist by failing to properly maintain the tree-well on the sidewalk where Fuller fell or fill it with the proper amount of mulch or gravel.

Fuller seeks trial by jury and seeks all damages in an amount to be proven at trial, with interest, attorney's fees, costs and such other relief to which he is entitled. He is represented by Abraham J. Saad and Adam L. Stone of Saad Dixon Law Offices PLLC in Huntington.
