CHARLESTON — A Kanawha County man is suing Kroger, alleging insufficient measures were taken to prevent injuries.
Jeffrey David Escue filed a complaint Sept. 27 in Kanawha Circuit Court against Kroger Limited Partnership, negligence in failing to maintain its store in a reasonably safe condition.
According to the complaint, on Oct. 3, 2015, while shopping at the Kroger on 1439 MacCorkle Ave., St. Albans, Escue fell and sustained serious and severe injuries to his knees, ankles, legs and foot. He says he has suffered great pain, inconvenience, loss of well being and loss of consortium.
The plaintiff alleges Kroger improperly operated and maintained it premises by failing to properly maintain the sidewalk, parking lot, entrances and exits at its property.
Escue seeks trial by jury, damages of at least $2,500 judgment in a fair and reasonable amount, pre- and post-judgment interest, fees, court costs and all other just and proper relief. He is representing himself in the case.
