Financing company alleges borrower, guarantors owe $35,000

KINGWOOD — A Huntington financing company is suing borrowers and guarantors,  alleging they owe more than $35,000 for breach of promissory note.

Windset Capital Corporation filed a complaint Sept. 27 in Preston Circuit Court against Diggers Construction, Thomas Pyles and Nancy Cramer, alleging they failed to fulfill their obligations under an agreement.

According to the complaint, on Nov. 9, 2015, Windset Capital funded a business loan to the defendants in the amount of $75,000. The suit says the defendants agreed to pay the amount (with interest, fees and other charges) in 48 equal weekly payments of $2,203.13. 

To date, the lawsuit states, the sum of $35,682.17 remains due and owing. The plaintiff alleges the defendants have failed to make the modified payments and failed to resume weekly payments as agreed.

Windset Capital seeks trial by jury, judgment, jointly and severally, for $35,682.17, interest, court costs and attorney fees, plus all other appropriate relief. It is represented by attorney Ryan S. Marsteller of Bailes, Craig & Yon PLLC in Huntington.
