Kanawha County couple alleges dealer sold defective vehicle

CHARLESTON — A Kanawha County couple is suing an auto dealer, alleging breach of contract, breach of warranty, negligent misrepresentation and unjust enrichment.

Bruno B. Yanish and Stephanie Yanish filed a complaint Sept. 28 in Kanawha Circuit Court against Dutch Miller of Charleston, Inc., and Santander Consumer USA Inc., alleging that they sold a vehicle that had several defects.

According to the complaint, on May 12, 2014, Bruno and Stephanie Yanish purchased a 2011 Dodge Journey from the defendants vehicle that had several non-conformities that impaired the use of the vehicle. 

The plaintiffs allege the defendants allowed the Yanishes to purchase the Dodge without informing them that the vehicle was a rebuilt wreck at the time of purchase. Instead, the suit says, the defendants said it was a good deal and the car had had low mileage and have refused to remedy the problem.

The Yanishes seek trial by jury, permanent injunction against the defendants, damages to be determined at trial, statutory penalty, and all relief the court grants. They are represented by attorneys Kristina Thomas Whiteaker and David L. Grubb of The Grubb Law Group in Charleston.
